Hyresnämnden

Hyresnämnden mediates in disputes about rent and tenant-owned apartment and decides, among other things, subletting, exchange, extension of rental agreements and the size of the rent. There are eight committees, and you apply to the one where the residence is located. The application must be in writing and is free of charge. The committee does not provide advice, but calls you to a meeting and tries to get you to agree.

What does hyresnämnden review?

The committee has two tasks. It mediates in rental and tenant-owned apartment disputes, and it reviews the issues that the law assigns to it. For you who rent or own a residence, it is usually these:

  • Permission to rent out a rental apartment in another hand, exchange an apartment or transfer the rental apartment (12 kap. 34 to 40 §§ jordabalken (the Swedish Land Code)).
  • Whether the rental agreement should be extended when the landlord has terminated it, and postponement of the move-out (12 kap. 49 and 59 §§).
  • The rent and other conditions (12 kap. 54 §), and repayment of too high rent in another hand (12 kap. 55 f §).
  • The rent when you rent from a private person according to the private rental law (2 kap. 5 §).
  • Defects that the landlord should rectify (12 kap. 11 and 16 §§).
  • For tenant-owned apartment: membership in the association, permission to rent out in another hand and measures in the apartment (2 kap. 10 §, 7 kap. 7 and 11 §§ bostadsrättslagen (the Swedish Housing Cooperatives Act)).

How do I apply to hyresnämnden?

The application must be in writing. It must include your and the counterparty's names and addresses, the address of the property or property designation, what you are requesting and the circumstances behind it. If you only want mediation, it is enough to describe what the dispute concerns. If something is missing, you will receive a request to complete it, and if you do not follow it, the application may be rejected. Attach copies of contracts, letters and other evidence.

Sveriges Domstolar has forms, including HN1 for a general application and HN1c for subletting. The template below follows the same information.

  4. Step 4: Attach copies of the contract, letters between you and other written evidence. The tribunal does not gather any investigation itself.

  5. Step 5: Send the application by email, via the e-service or by post. It is free of charge.

  6. Step 6: Attend the meeting. If you who applied do not attend, the case will be dismissed.

  7. Step 7: Read the decision and the reference to appeal. An appeal must have been received by the tribunal within three weeks.

What happens at the meeting?

When the application is complete, the committee sends a copy to the opposing party and asks them to comment. In most cases, you are then called to a meeting. There, a rental committee, which is a judge and chairman, and two interest representatives with experience in property management and tenants' or tenant-owned apartment owners' affairs, are present. You get to tell, show documents and pictures, and sometimes the committee inspects the home.

The committee will try to get you to agree. If you do, the committee can establish the settlement, and then it applies as a judgment. Otherwise, the committee decides the dispute if it is one of the issues that the committee reviews, and in other cases, the case is dismissed. If you, who have applied, fail to appear, it is also dismissed.

What is mediation in hyresnämnden?

Mediation means that the committee helps you to agree without deciding the issue. You can request only mediation, and the committee tries to reconcile the parties even when no one has requested it. During mediation, the committee may consist of only one rental committee.

Hyresnämnden and tenant-owned apartment

The committee also reviews certain issues between a tenant-owned apartment association and its members. Most common is permission to rent out the tenant-owned apartment when the board has said no. The committee grants permission for a certain period if you have reasons and the association lacks a valid reason to refuse. The committee also reviews disputes over membership when the association denies a buyer. Read more in the guide to renting out a tenant-owned apartment.

Can I appeal the rental committee's decision?

Many decisions can be appealed to the Svea Court of Appeal, including extension disputes, rental terms and membership in a tenant-owned apartment association. The appeal must be in writing and have been received by the committee within three weeks of the decision. Decisions on permission to exchange and subletting are usually not appealable, unless the committee allows it. The Svea Court of Appeal's decision is final.

More about hyreslagen

The rules that the committee applies, from notice to possession protection, are stated in the guide to hyreslagen (the Swedish Tenancy Act).

Common questions

Does it cost anything to apply to hyresnämnden?

No. The application is free of charge according to Sveriges Domstolar. It must be in writing, and it is voluntary to have a representative.

Can I call hyresnämnden and ask about my case?

You can call and ask about how the processing is done. The committees do not represent the parties, do not provide legal advice, and do not give advance notice of how a dispute will be assessed.

Does hyresnämnden settle disputes about deposits?

No. A claim to get back a deposit is not one of the disputes that section 4 of the law on rental committees and tenant committees lists. The claim is brought to court, within two years from when you left the home (12 kap. 61 § jordabalken).

Can hyresnämnden give me permission to sublet my tenant-owned apartment?

Yes. If the board says no, hyresnämnden can give permission for a certain time if you have reasons and the association lacks a justified reason to refuse (7 kap. 11 § bostadsrättslagen).

What happens if the parties agree at the meeting?

You can ask the committee to establish the agreement in a decision. Then the agreement applies as a judgment, according to the Swedish Courts.
