How do you move in together?

When you are moving in together in a rental apartment, no permission from the landlord is needed, but notify them that your partner is moving in. Decide whose home you are moving to, since an apartment that one of you had before is not included in the division of property in the event of a separation. The one who is moving does flyttanmälan (notification of change of address), and you make sure that the home insurance covers you both.

What should you think about when you are going to move in together?

  1. Step 1: Determine whose home you are moving to, or if you are getting a new one together. This determines what is considered cohabiting property if you separate.

    3 § cooperation law (2003:376), verified 5 October 2026

  2. Step 2: Write a cohabitation agreement if the home or property should not be divided equally in the event of a separation. The agreement must be in writing and signed by both of you.

    9 § cooperation law (2003:376), verified 5 October 2026

  3. Step 3: Inform the landlord that your partner is moving in and ask for their name on the door and in the stairwell. No permission is required.

Does the landlord need to approve that you move in together?

No. Hyresgästföreningen writes that you do not need the landlord's permission to move in together and become cohabiting partners. However, it is a good idea to inform the landlord so that your partner's name appears in the stairwell and on the mailbox. It is also then that you can ask if you can both be on the contract. The latter is our advice.

Whose apartment will you move to?

The choice has consequences if you separate one day. According to the cohabitation law, your joint home and your property are joint property if they have been acquired for joint use. It is the joint property that is divided in a division of property, and the main rule is according to Hyresgästföreningen that the one who needs the home most gets to stay, regardless of who is on the contract.

If one of you had the apartment before you moved in together, it is not included in the division of property. Furniture that one of you bought before the cohabitation is not considered joint property either. The one who moved in can still get to take over the apartment according to 22 § sambolagen, but only if they need the accommodation most and it is reasonable. If you have no children together, special reasons are required. With a written cohabitation agreement, you can agree that certain property should not be shared.

Can my partner take over the rental contract?

There are three ways, and all assume that you live together. If you, who are on the contract, want to move out and leave the apartment to your sambo, you can transfer the hyresrätt to a close relative who permanently lives with you, if hyresnämnden gives permission. Hyresgästföreningen writes that it then requires that you have lived together for a longer period, up to three years. If you cancel the agreement, a sambo who lives in the apartment may have the right to take over it, if the landlord can reasonably accept the sambo as a tenant. And in the event of a separation, the apartment can go to the sambo through division of property, and then the sambo gets to take your place.

Can you trial live and rent out your apartment during that time?

Yes. According to Hyresgästföreningen, you can rent out your apartment for a trial period of living together, and it is usually possible to get permission for six months up to one year. The subletting requires the landlord's consent or the permission of the rental tribunal. Special family circumstances are one of the reasons that jordabalken (the Swedish Land Code) lists for hyresnämnden to give permission, and the permission is limited to a certain period. How the application and contract are handled is stated in the guide to subletting.

What happens to home insurance and the address?

According to the Consumers, your partner is often co-insured in your home insurance if you are registered at the same address and share a household. Several insurance companies still require that all those to be covered are named in the insurance policy. Call the company before the move and cancel the insurance that will be excess. If you live in a rental apartment with a first-hand contract, you should always have home insurance.

The person moving makes flyttanmälan to Skatteverket, before the move or at the latest one week after. Then the new address applies from the move-in date. If you report a move to an address where someone else is already registered, Skatteverket may send a control question to that person, so tell your partner that the letter may arrive. More about flyttanmälan can be found in the guide on change of address, and all dates can be entered in Your moving plan.

Common questions

Does the landlord need to approve my partner moving in?

No. According to Hyresgästföreningen, no permit is required to move in together and become cohabiting partners in a rental apartment. However, inform the landlord so that your partner's name is added to the door and in the stairwell.

Is my rental apartment included in the division of property if we separate?

Not if you had the apartment before you moved in together. Joint property is only housing and furniture acquired for joint use. Your partner may still be able to take over the apartment in exceptional cases, according to 22 § of the Cohabitation Act.

Is it enough to have a home insurance when we move together?

Often. According to Consumers, the partner is often co-insured if you are registered at the same address and share a household, but several companies require that all names are listed in the insurance policy.

How long do you have to live together to be counted as a partner?

The law does not specify any time. Hyresgästföreningen writes that you should have lived together for at least six months as a guideline, or had the intention of doing so, and that you should have a joint household.
